2. The Contract

2.1. Order Process: When you place an order on our website, you will receive an automated acknowledgement email. This email acknowledges receipt of your order but does not constitute acceptance of it. 2.2. Contract Formation: A binding contract between you and The Honest Plank is formed only when we dispatch your goods and send you a "Dispatch Confirmation" email. 2.3. Right to Decline: We reserve the right to decline any order for any reason prior to dispatch (e.g., stock issues, pricing errors, or inability to authorize payment). If we cancel your order, a full refund will be issued.

3. Product Descriptions & Natural Materials

3.1. Accuracy: We take reasonable care to ensure that all details, descriptions, and prices of products appearing on the website are correct. 3.2. Natural Wood Variation: As our products are crafted from real wood, please be aware that wood is a natural material. Variations in grain, texture, knots, and colour are natural characteristics and are not considered faults. Your bed frame may differ slightly in appearance from the photographs shown on the website due to these natural variations.

4. Price and Payment

4.1. Payment Methods: We use Wix to process payments securely. We accept the following payment methods:

  • Credit and Debit cards (Visa, Mastercard, American Express)

  • Apple Pay

Google Pay 4.2. Excluded Methods: We do not accept "Buy Now, Pay Later" services (such as Clearpay/Afterpay) or cash on delivery. 4.3. Payment Timing: Payment is taken in full at the time of placing your order.

5. Delivery

5.1. Delivery Location: We deliver to addresses within the United Kingdom (excluding Highlands/Islands) 5.2. Data Sharing for Delivery: In accordance with our Privacy Policy, we share your Phone Number and Email Address with our nominated courier. This is a contractual necessity to allow them to contact you regarding your delivery window. 5.3. Customer Availability: It is your responsibility to ensure you (or a nominated adult) are available to accept the delivery. 5.4. Failed Deliveries: If you fail to provide accurate contact details (phone/email), or if you are not available to accept the delivery after a time has been agreed, we reserve the right to charge for redelivery costs.

7. Faulty Goods

7.1. If your item arrives damaged or develops a fault, you have rights under the Consumer Rights Act 2015. 7.2. Upon Receipt: Please inspect your goods upon delivery. If items are damaged in transit, please refuse the delivery or sign for it as "Damaged" and notify us immediately. 7.3. Within 30 Days: If a product is faulty, you are entitled to a full refund within 30 days of delivery. 7.4. After 30 Days: We have the right to repair or replace the faulty item.

8. Privacy & Data Protection

8.1. We respect your privacy and handle your data in accordance with the UK GDPR. 8.2. Courier Data Sharing: To fulfill your order, we share your Name, Address, Phone Number, and Email with our delivery partners. Our delivery partners are strictly prohibited from using your personal data for their own marketing purposes. 8.3.

9. Liability

9.1. We are only responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence. 9.2. We are not liable for business losses. We only supply the products for domestic and private use. If you use the products for any commercial, business, or re-sale purpose, we will have no liability to you for any loss of profit, loss of business, or business interruption.

10. Governing Law

These terms are governed by English law and you can bring legal proceedings in respect of the products in the English courts. If you live in Scotland or Northern Ireland, you can bring legal proceedings in either the Scottish or Northern Irish courts or the English courts.
